TERMS AND CONDITIONS OF USE
These Terms and Conditions of Use (“Terms”) are entered into between Devfellowship (“Devfellowship”) and you, who may act as a Fellow, Client, or Mentor (collectively referred to as “Users”), and govern the use of the digital platform made available by Devfellowship (www.devfellowship.com) (“Platform”).
These Terms set forth the general conditions applicable to the use of the Platform, and by accepting them, the User declares that they are aware of and agree with their content and the other Devfellowship policies.
These Terms and any amendments hereto prevail over any proposals, agreements, or understandings, whether oral or written, that may exist between the User and Devfellowship.
1. DEFINITIONS
In the interest of transparency and communication, the following definitions are provided in addition to those mentioned previously, clarifying the technical terms and concepts that may be addressed in these Terms:
- Fellows: students or professionals who wish to develop programming and technology skills through classes and other types of content, real projects, mentorship, and practical activities.
- Clients: companies or legal entities that use the Platform to contract projects or request microtasks.
- Mentors: senior professionals responsible for guiding Fellows, supervising deliverables, and ensuring the technical quality of projects for Clients.
- User: any individual or legal entity that uses the Platform under any of the categories above.
2. OUR SERVICES
Devfellowship is a digital platform designed to accelerate the technological evolution of Fellows by providing the opportunity to develop skills through real projects, while offering Clients the possibility to scale their products with access to qualified talent, flexibly and without the burden of traditional hiring. For Mentors, the Platform serves as a space for engagement, knowledge sharing, and professional recognition.
Devfellowship will provide the User with a specific set of functionalities and tools to optimize the use of the Platform and its services. These functionalities will be selected by Devfellowship and made available according to the User’s account category and may be updated at any time, with the relevant information made available on our website (https://devfellowship.com/) or through official support channels.
By using the Platform, the User may access, among others, the following features:
For Fellows:
- Learning Platform: courses and video lessons on programming and software development;
- Personalized Mentorship: weekly 1-on-1 sessions with senior professionals to accelerate learning and overcome technical challenges quickly;
- Payment System: compensation for completed tasks, with payments released within 48 hours, without bureaucracy or delay.
For Clients:
- Squad as-a-Service: access to complete squads with developers, designers, and product managers, scalable as needed, with quality guaranteed by our Mentors;
- Projects: execution of complete projects, from MVP to final product, with a simplified contracting model and predictable costs and timelines;
- Micropayments: pay only for what you need, when you need it, ideal for small features, fixes, or quick tasks starting at two (2) hours of development.
For Mentors:
- Continuous Engagement: mentoring sessions, code reviews, project supervision, and technical guidance for groups of Fellows;
- Community Growth: participation in workshops, creation of educational content, and collaborative technical curriculum development;
- Rewards and Recognition: revenue-share from mentored projects, access to exclusive events, and recognition as a reference within the tech ecosystem.
Each product and service has its own specifications, which may change at any time. The User must comply with the specific terms and conditions applicable to each engagement, which will be made available by Devfellowship in a separate agreement before formalization.
3. ACCOUNT REGISTRATION
To access all functionalities, the User must register and maintain an active account on our Platform, providing Devfellowship with personal data, which will be handled according to privacy and data protection laws.
By registering and using our services, the User declares:
- They are at least 18 years old and legally capable;
- Their data is accurate and up-to-date;
- Their login credentials are personal and non-transferable;
- They are responsible for the truthfulness of all information provided.
Devfellowship may, at any time, monitor activities on its Platform, adopt security and anti-fraud measures, and deny access if any fraudulent or illicit behavior is detected.
4. PLATFORM USE AND USER RESPONSIBILITIES
By accessing and using the Platform, the User agrees to act in good faith, with respect, and in compliance with applicable laws. Devfellowship’s Platform is a collaborative environment connecting Fellows, Clients, and Mentors, relying on responsible conduct from all participants.
4.1. GENERAL RESPONSIBILITIES
The User agrees to:
- Comply with all Terms, policies, and laws;
- Be solely responsible for financial operations performed through the Platform;
- Not use the Platform for illegal or inappropriate purposes;
- Not send offensive, obscene, or harmful content;
- Not share or upload content that infringes copyrights, trademarks, privacy, or other rights, or that includes malware or attempts to manipulate or damage the Platform;
- Indemnify Devfellowship for any damages or legal claims arising from prohibited actions.
4.2. FELLOWS’ RESPONSIBILITIES
Fellows agree to:
- Perform assigned tasks and projects diligently and on time;
- Participate in mentorship and learning activities respectfully;
- Provide accurate information about their skills and availability;
- Understand that payment is conditional upon delivery and approval of work.
4.3. CLIENTS’ RESPONSIBILITIES
Clients agree to:
- Provide clear and complete information about requested projects or squads;
- Make payments promptly and as agreed;
- Maintain ethical and respectful conduct in all interactions.
4.4. MENTORS’ RESPONSIBILITIES
Mentors agree to:
- Conduct mentorships professionally and respectfully;
- Ensure the technical quality of supervised projects.
5. PLATFORM LIABILITY LIMITATIONS
Devfellowship strives to ensure service availability but may undergo maintenance, updates, or emergency repairs.
The Platform is not liable for lost profits, data, or incidental or consequential damages.
Users agree that Devfellowship is not responsible for:
- Access interruptions or platform failures;
- Temporary downtime;
- Service discontinuations;
- Outdated or inaccurate data provided by Users;
- Malware or harmful elements introduced externally;
- Technical failures beyond Devfellowship’s control;
- Modifications made without prior notice;
- Improper use of the Platform;
- Financial losses from product or service use.
6. ACCOUNT SUSPENSION OR CANCELLATION
Devfellowship may suspend or cancel a User account if:
- Terms or policies are violated;
- False identity is detected;
- Fraudulent or illegal acts are suspected.
7. PRIVACY AND DATA PROTECTION
Devfellowship processes personal data in compliance with applicable laws, especially Brazil’s General Data Protection Law (LGPD – Law No. 13.709/2018).
8. INTELLECTUAL PROPERTY
All content available on the Platform, including trademarks, logos, videos, courses, layouts, software, and source code, is the exclusive property of Devfellowship, protected by applicable laws.
Any reproduction, distribution, or derivative work without written consent is prohibited and may result in legal action.
For deliverables defined by contract, intellectual property may be transferred to the Client upon full payment, as specified in the respective agreement.
9. GENERAL PROVISIONS
If any provision is deemed invalid, the remaining provisions remain effective.
The Platform may include third-party links, which do not imply endorsement. Users are responsible for reviewing external terms and privacy policies.
Use of the Platform does not create any employment, partnership, or subordination relationship between Devfellowship and its Users.
10. CHANGES AND UPDATES
Devfellowship may modify these Terms at any time and will notify Users via email. Continued use after publication constitutes acceptance of the updated Terms.
11. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of the Federative Republic of Brazil.
The court of Maringá–Paraná is elected to resolve disputes, without prejudice to the User’s right to choose their domicile’s jurisdiction.
